Canada’s food inspection agency stated it aims to start a total removal of numerous ostriches at a ranch following the highest judicial body declined to stop the controversial eradication.

Legal Impediments Removed by Supreme Court Decision

The recent judicial decision removed any legal impediment to starting the culling.

Universal Ostrich Farms, situated close to the community of Edgewood, was first ordered in May to eradicate close to 400 ostriches, amid concerns of an outbreak of avian influenza.

Recently, officials seized control of the business.

Sixty-nine ostriches have previously perished after the emergence of a flu-like illness.

On Wednesday, Canada’s supreme court granted an temporary halt on the cull order as it considered whether to hear the case.

The increasing controversy over the birds – and a lingering distrust of government – have motivated demonstrators to descend on the property, with many expressing their frustration on social media.

The case has also penetrated the nation’s political sphere.

Earlier this fall, the opposition leader, the Tory leader, was questioned twice by reporters whether he supported the demonstrators.

The Tory leader has avoided making specific comments on the issue, even though many within his party protesting against the slaughter.

He informed the press the situation had been “mismanaged from the very beginning” but didn’t say the word “ostrich”.

Cross-Border Interest and Proposals

Several prominent individuals from the US have lobbied authorities in Canada.

The US health secretary offered to relocate the birds to his property in Florida.

An US wealthy businessman has also appealed with the authorities to rescind its eradication directive.

Scientific and Ethical Arguments

The national authorities stated the relevant agency was following a “stamping out” approach in order to contain the spread of avian flu, a step in line with wider advice from international health bodies.

However, animal rights organizations have called on the agency to perform additional tests on the birds to verify they are carrying the virus.

The ranch operators said that because the last bird flu death happened on 15 January 2025, with the surviving majority appearing in good condition or healed, the flock has acquired at least some level of immunity against the virus.

They have also cast doubt on the scope and effectiveness of testing on the ostriches.

Farm Spokesperson Reaction

Recently, the ranch representative, informed the media that the agency was “murdering” healthy birds.

“These are ancient creatures that have endured eons, but they won’t endure the government agency,” she stated.

A partner expressed he was concerned that there is no fairness left”.

Judicial and Authority Findings

A federal court, however, found that allowing the ostriches to remain alive could result in the transmission of bird flu to different species, the livestock sector – or to humans.

The authority has not announced at what time it expects to start slaughtering the birds.

Eradication Procedures

An older agency manual, acquired under freedom of information laws, states the birds can be euthanized by different means, the recommended being lethal injection, which requires multiple individuals: one to hold the ostrich by restraining it, another to secure the head, and one to inject the drug.

Personnel can also use gas or neck dislocation.

Members of the organization can only shoot the birds in extreme circumstances, if they have a trained shooter on site.
